PresetShare ("I", "me", "my") is owned and operated by the PresetShare creator.
By accessing or using PresetShare, you agree to these Terms of Use. If you do not agree with them, please do not use the service.
User Content
PresetShare is a community-driven platform. Content available on the site, including presets, samples, audio files, project files, images, descriptions and other materials ("User Content"), may be uploaded by users of the service.
You may only upload content that you created yourself or that you otherwise have the right to share and distribute.
You retain any rights you have in the content you upload. By uploading content to PresetShare, you grant PresetShare a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display and distribute that content as necessary to operate and promote the service.
PresetShare does not review or verify the ownership, copyright status, licensing status or legality of every file uploaded by users. Users are solely responsible for the content they upload and for ensuring that they have the necessary rights to share it.
Previously Uploaded Content
These Terms also apply to content uploaded before this version of the Terms was published. From the date these Terms take effect, previously uploaded content is treated the same way as newly uploaded content: the uploader retains any rights they have in it and grants PresetShare the license described above.
Earlier versions of these Terms stated that uploaded content was considered to be in the public domain. To the extent permitted by applicable law, content uploaded while those earlier terms were in effect may remain freely usable under that earlier dedication. If you uploaded content under the earlier terms and object to its continued availability, you may delete it or contact me at [email protected].
Using Content from PresetShare
Content made available for download is intended for individual use according to the permissions or license associated with that content, if any.
The availability of content on PresetShare does not transfer ownership of that content to you and does not automatically grant permission to redistribute, republish or commercially resell the original files.
You may not systematically copy, scrape, crawl, bulk-download, aggregate, reproduce or republish content or data from PresetShare for the purpose of creating or populating another website, database, content library, marketplace, archive or similar service.
You may not mirror PresetShare or reproduce a substantial part of its catalog, including files, metadata, descriptions, tags, categories, previews, ratings, statistics or other data.
Automated access, scraping or bulk collection of PresetShare content is prohibited unless you have received explicit permission from me.
Downloading individual files through the normal functionality of PresetShare does not grant permission to redistribute those files as a collection or to use them to build another content service.
Copyright and Intellectual Property Complaints
PresetShare respects the intellectual property rights of others and expects its users to do the same.
Because PresetShare contains content uploaded by users, I cannot independently verify the ownership or licensing status of every uploaded file. The person uploading content is responsible for ensuring that they have the necessary rights to upload and share it.
If you are a copyright owner, or are authorized to act on behalf of one, and believe that content available on PresetShare infringes your rights, please contact me at [email protected].
Your notice should include:
- Identification of the copyrighted work or other material you believe has been infringed.
- A link or other information sufficient to locate the allegedly infringing content on PresetShare.
- Your name and contact information.
- A statement explaining the basis of your claim and confirming that you are the rights holder or are authorized to act on behalf of the rights holder.
- Any additional information or evidence reasonably necessary to evaluate the claim.
I will review legitimate complaints and may remove or restrict access to content where appropriate. I may also notify the user who uploaded the content in question.
Where applicable, notices submitted under the U.S. Digital Millennium Copyright Act (DMCA) or similar copyright procedures may also be processed in accordance with applicable law. Repeated or clear infringement may result in removal of content and restriction or termination of the responsible account.
Submitting false, misleading or abusive copyright claims may result in rejection of the request and other appropriate action.
Your Account
You are responsible for all activity performed through your account and for keeping your login credentials secure.
Do not use PresetShare for anything illegal, abusive, fraudulent or harmful to other users or to the service.
Do not attempt to interfere with the operation or security of PresetShare, bypass technical restrictions, abuse the API or other endpoints, or place unreasonable automated load on the service.
I may restrict, suspend or delete accounts and remove content at my discretion, including where I believe these Terms have been violated.
PresetShare Content and Database
The PresetShare website, its software, design, branding and original materials created for the service remain the property of their respective owner.
The organization, presentation and compilation of the PresetShare catalog, as well as site-generated metadata and other original elements of the service, may also be protected by applicable intellectual property and database rights.
Nothing in these Terms grants permission to copy or operate a clone, mirror or substantially similar reproduction of PresetShare or its catalog.
Disclaimer and Limitation of Liability
PresetShare provides a platform for users to share content. The service and all User Content are provided "as is" and "as available". I do not guarantee that User Content is accurate, safe, legally distributable, free from third-party rights, or suitable for any particular purpose, and I do not guarantee uninterrupted or error-free operation of the service.
To the fullest extent permitted by applicable law, PresetShare and its owner will not be liable for claims, losses, damages, penalties or expenses arising from User Content, your use of downloaded content, or your use of the service.
If a dispute concerns content uploaded by a user, responsibility for that content remains with the user who uploaded it, except where applicable law provides otherwise.
Changes to These Terms
These Terms of Use may change from time to time. Continued use of PresetShare after updated Terms are published constitutes acceptance of the updated Terms to the extent permitted by applicable law.
